Broadcom prosecutor admits leaks to media

A federal prosecutor in the Broadcom options-backdating case admitted to the court that he leaked information to reporters. The assistant U.S. attorney Andrew Stolper said that it was a “lapse of judgment”.

The assistant attorney might be called as a witness by Ruehle’s defense attorneys – he will be testifying about his conduct in the case.

He was accused of causing Nancy Tullos’ (a witness) firing, due to the leaked information. Furthermore, James Asperger has testified that he was feeling threatened by Stolper’s comments regarding a SEC testimony Dull gave. Also due to his actions judge Carney disallowed Stopler to be in the courtroom during Samueli’s testimony.

SANTA ANA – A federal prosecutor in the Broadcom options-backdating case admitted in court Wednesday that he told journalists about Broadcom co-founder Henry Samueli’s refusal to cooperate with federal investigators in 2007.

“Without a doubt, it’s the stupidest thing I’ve done in my career,” Assistant U.S. Attorney Andrew Stolper said. “Admittedly, not smart, admittedly, a lapse of judgment.”

    So what do we do about this “lapse of judgement”? Is it that easy to get out of misconduct? Would the government let one of these CEOs they are choosing to charge off the hook with a statement such as a “lapse of judgement”? I truly doubt it.

    At least the Judge has enough sense to dismiss the case.

    Really, thank God for the judge. He was able to realize just what these prosecutors were doing; lying, leaking information and getting innocent people fired.

    These prosecutors knew that when they leaked the information to the press that the press would then turn this whole backdating issue into an even bigger scandal. The facts are it’s not that big of a deal, it’s not illegal.

    Maybe leaking information to the public/press isn’t that bad of an idea… Then the world can see that backdating is not illegal and this whole thing is a waste of their money!!
